Auto-entrepreneur in France alongside unemployment, a job or retirement

Being an auto-entrepreneur (a self-employed person under France’s micro-business regime) and unemployed at the same time is possible: the France Travail (the public employment service, formerly Pôle emploi) benefit can continue while your micro-entreprise (France’s micro-business regime) gets going, within certain limits. The same regime can also be combined with a salaried job, a civil service post or a pension. Each situation has its own rules, and they’re what decide what you keep. Here, we start with unemployment, because it’s the most asked question, then move on to the other three.

The rules are those in force in 2026, checked on France Travail, Entreprendre.Service-Public.fr, Légifrance and L’Assurance retraite on 30 September 2026.

A word on vocabulary: in official texts, the auto-entrepreneur is called a micro-entrepreneur. It’s the same person, under the micro-entreprise regime.

Can you be an auto-entrepreneur and receive unemployment benefit?

Yes. If you receive the ARE (unemployment benefit, allocation d’aide au retour à l’emploi), you can create your micro-entreprise and keep part of your benefit. Two basic conditions: stay registered with France Travail and declare the income from your activity every month, when you update your situation (actualisation).

You then have to choose between two formulas, which can’t be combined with each other:

France Travail says it plainly: the ARE and the ARCE are mutually exclusive. The next two sections help you compare.

How the ARE is calculated when you’re an auto-entrepreneur

Every month, France Travail starts from your normal ARE and deducts 70% of the income from your activity. The more your micro-entreprise brings in, the less benefit you receive, but you continue to be paid as long as your entitlement isn’t used up.

For an auto-entrepreneur, the income taken into account isn’t the gross turnover. It’s the turnover minus your activity’s flat-rate allowance (abattement forfaitaire):

Activity Allowance Income taken into account for €1,000 of turnover
Sales of goods 71% €290
Commercial or craft services 50% €500
Non-commercial profits (liberal professions) 34% €660

An example, calculated from these rules: your normal ARE is €1,200 a month and you receive €1,000 of turnover from liberal-profession services. The income taken into account is €660, 70% of that income is €462, and your ARE for the month goes down to €738.

Two ceilings are added:

  • the ARE and the income from the activity, added together, can’t exceed the average monthly salary that was used to calculate your ARE;
  • since 1 April 2025, the combination is limited to 60% of the ARE entitlement you have left on the date the business is created. According to France Travail, this limit applies to entitlements opened after a contract ended on or after that date. Once this ceiling is reached, payments stop; France Travail says you can then ask the regional joint body (instance paritaire régionale) to continue on the remaining 40%.

You declare to France Travail your activity income subject to contributions. When it isn’t known yet, France Travail can pay an advance and adjust it later, every quarter for a micro-entrepreneur. Keep your URSSAF (the body that collects social-security contributions) declarations to hand: they’re what justify your amounts.

If your micro-entreprise existed before you became unemployed

The case is different if you already had your auto-entrepreneur activity alongside a salaried job, and you lose that job involuntarily. Service-Public says that you can then combine in full the ARE and the income from your self-employed activity. The 60% ceiling applies to businesses created after registration, not to this one.

ARCE or keeping the ARE: which to choose?

The ARCE turns part of your entitlement into capital. According to France Travail, for entitlements opened since 1 July 2023, it’s worth 60% of the remainder of your ARE entitlement on the date of creation. France Travail withholds a 3% contribution for the supplementary pension, and the aid is subject to CSG and CRDS (social levies).

It’s paid in two instalments:

  • the first half when all the conditions are met;
  • the second half six months later, if you’re still carrying on your activity and you don’t hold a full-time salaried job on a permanent contract (CDI).

To be entitled to it, you must be entitled to the ARE and benefit from the ACRE (start-up relief on contributions). But since 1 January 2026, the ACRE is no longer automatic: you must apply for it to the URSSAF within 60 days of your activity starting. It’s all explained in the article on the ACRE for the auto-entrepreneur.

Keeping the ARE ARCE
Form A top-up every month Capital in two payments
Amount ARE minus 70% of activity income 60% of the remainder of your entitlement
Limit 60% of remaining entitlement, reference salary None beyond the capital
ACRE required No Yes
If you stop the activity You keep the entitlement you haven’t used You can recover the rest of your entitlement

If your activity stops after an ARCE, France Travail says you can recover your remaining entitlement as ARE, by registering again, within three years from the opening of your entitlement, plus its initial duration.

Keeping the ARE protects a slow start: if you invoice little in the first months, the benefit stays almost whole. The ARCE suits a project that needs cash straight away, or an activity that will bring in money quickly. France Travail offers an ARCE simulator on its website to put figures on your case.

Can you be an auto-entrepreneur and an employee?

Yes. Combining a salaried job and a micro-entreprise is allowed, under a few conditions set by Service-Public and the Labour Code.

  • The exclusivity clause. A full-time contract can include one, which forbids any other professional activity. It isn’t possible for a part-time employee. And article L1222-5 of the Labour Code specifies that the employer can’t enforce any exclusivity clause for one year against an employee who creates or takes over a business (sales representatives, VRP, are the exception).
  • The duty of loyalty. Even without a clause, you must stay discreet, respect confidentiality and not harm your employer’s interests, for the whole duration of the contract. Approaching their clients for your micro-entreprise, for example, can breach it.
  • Working time. Your auto-entrepreneur activity is carried on outside your salaried working time.

On the social protection side, you contribute to both schemes: on your salary through your payslip, and on your turnover as an auto-entrepreneur. Service-Public specifies that your rights to benefits stay open in the scheme of the activity you carried on before combining.

A contract that forbids competition after you leave (non-compete clause) or imposes confidentiality continues to apply once the contract has ended. Reread your contract before choosing your activity.

Civil servant and auto-entrepreneur: what’s allowed

A public employee can’t combine activities freely. The Code général de la fonction publique (the general civil service code) provides two routes.

A secondary activity, with authorisation. Article R123-8 lists eleven categories of activities that an employee can be authorised to carry on alongside their job, outside their working hours and without harming the operation, independence or neutrality of the service: expertise and consulting, teaching and training, sporting or cultural activities, small jobs for private individuals, among others. The first nine can be carried on under the micro-entreprise regime. For two of them, the micro-entreprise is mandatory:

  • personal services;
  • the sale of goods produced personally by the employee.

The application is made to your line management before you start.

Creating a business by going part-time. The civil service portal states that to create or take over a business, or to practise a liberal profession, the employee must be placed on part-time work, at at least 50% of full time. The authorisation is valid for three years, renewable for one year, so four years in total.

Two cases escape the authorisation: an employee on reduced hours whose working time doesn’t exceed 70% of full time declares their private activity without having to have it authorised, and producing works of the mind (writing, creating an artistic work) remains free.

Retiree and auto-entrepreneur: combining work and a pension

You can receive your pension and work as an auto-entrepreneur. There are two schemes: full combination and capped combination (of work and a pension, cumul emploi-retraite).

Full combination lets you earn without limit. You must meet all these conditions:

  • have reached the legal retirement age;
  • have a full career, or have reached the age for an automatic full-rate pension (67 for people born from 1955 onwards, according to L’Assurance retraite);
  • have claimed all your basic and supplementary pensions, French, foreign and from international organisations.

In that case, your auto-entrepreneur contributions let you build up a second pension. A third isn’t possible.

Capped combination applies if you don’t meet these conditions. Service-Public sets these annual ceilings for 2026:

Situation Annual ceiling
Affiliation to the Cnav €24,030
Affiliation to the Cnavpl (liberal professions) €48,060
Activity in a France ruralités revitalisation zone (ZFRR) or in a priority urban zone €48,060

If you exceed the threshold that corresponds to your situation, your pensions are no longer paid. Your supplementary pension follows the same rule as your basic pension.

Service-Public asks you to inform the Cnav (the national pension fund) in writing that you’ve taken up a self-employed activity within the month that follows. What your auto-entrepreneur contributions give you towards your pension is detailed in the article on the auto-entrepreneur’s pension.

And CAF benefits?

Being an auto-entrepreneur doesn’t stop you receiving the RSA, the prime d’activité (in-work benefit), the AAH (disabled adult allowance) or housing aid. You simply have to declare your activity to the CAF (the family allowance fund).

For the RSA (the minimum income) and the prime d’activité, you declare your income every three months. On caf.fr, you enter your gross turnover, month by month, in the box that corresponds to the nature of your activity: sales of goods, commercial or craft services, or other services. The CAF applies the allowance itself. If you carry on several activities, you declare the gross turnover of each.

Take the amounts from your URSSAF declaration for the quarter: they’re the same takings, and identical figures on both sides save you having to explain yourself later.

Summary

  • Unemployed: ARE reduced by 70% of your activity income, within the limit of 60% of your remaining entitlement, or the ARCE as capital, with the ACRE. Never both.
  • Employee: no exclusivity clause enforceable for one year if you create your business, loyalty always.
  • Civil servant: an authorised secondary activity, or part-time work of at least 50% to create one.
  • Retiree: full combination if all your pensions are claimed and your career is full, otherwise a ceiling of €24,030 or €48,060.

To launch the activity itself, follow the guide to creating a micro-entreprise.

Combining is above all about knowing the rule on each side well: once it’s clear, your micro-entreprise can grow without surprises.
